This includes custom commissions, original artwork, prints, and merchandise. Throughout the Site, the terms “we,” “us,” and “our” refer to Spikes Art Studio.
By accessing the Site, placing a commission, or purchasing any product, you agree to be bound by these Terms. We may update or revise these Terms at any time without prior notice, so please review them before each order.
1. Use of Our Website
You agree to use the Site for lawful purposes only and in accordance with all applicable laws and regulations. You are prohibited from:
Using the Site for any illegal or unauthorized purpose
Violating any intellectual property, privacy, or publicity rights
Attempting to gain unauthorized access to the Site, its systems, or user data
Uploading or transmitting viruses, malware, or any destructive code
Submitting false, misleading, or deceptive information through contact forms or inquiry channels

2. General Conditions
We reserve the right to decline service to any user at any time for any reason. You understand and agree that non-sensitive content (excluding payment information) may be transmitted across various networks and may be modified to meet technical requirements for system compatibility. All credit card details are securely encrypted during network transfers.
You may not duplicate, copy, resell, or exploit any part of the Site or its content without express written permission. Section headings are included for ease of navigation only and do not affect the interpretation of these Terms.
3. Inquiries & Communications
We reserve the right to decline or disregard inquiries that appear to be:
Unclear or unverifiable in nature
Outside the scope of a typical business request
Submitted with incomplete, misleading, or deceptive information
Sent under false pretenses, including pretexting, impersonation, or using other forms of fraudulent or deceptive contact methods
All communication should remain professional and relevant to the services offered. Any message that raises security concerns or appears intended to bypass normal business boundaries may be reported or blocked at our discretion.
4. Ordering Process
To initiate a commission, clients must complete the provided form and submit all required details, such as reference images, preferred medium, size, and specific requests. We will communicate with you to finalize the details. Please note: submitting the form does not constitute a formal order. A commission is confirmed only after mutual agreement.
5. Payment Terms – Commissions
A 50% non-refundable deposit is required before work can begin on any commission or custom piece. The remaining balance is due upon completion and must be paid before the artwork is delivered or shipped.
Accepted payment methods include: Cash, PayPal, Venmo, and Zelle.
6. Work In Progress (WIP) Updates – Commissions
Clients will receive progress updates at major project milestones (e.g., sketch, base layers, detailing). Minor revisions can be requested during these phases at no extra cost. Significant changes requested after a stage is approved may incur additional charges.
7. Completion and Delivery – Commissions
Estimated turnaround times for commissions vary by medium, size, and complexity and will be communicated during the ordering process. Delivery will be done through shipping.
Shipping costs for commissions will be discussed in advance and billed separately unless otherwise stated.
8. Cancellation and Refund Policy – Commissions
The initial 50% deposit is non-refundable once work has begun. If canceled before any work starts, a full refund may be possible. No refunds will be given after the final artwork is delivered. For more details, view the Return Policy page.
9. Ordering Prints & Merchandise
Products such as prints, stickers, or other merchandise may be produced either in-house or through third-party vendors. By placing an order, you agree to review item descriptions, dimensions, and delivery times before completing your purchase.
10. Shipping – Prints & Merchandise
We ship prints and merchandise domestically using standard carriers. Shipping costs will be calculated at checkout or communicated in advance. Please ensure your shipping information is correct at the time of purchase. We are not responsible for delivery delays caused by carriers or incorrect addresses.
11. Returns & Refunds – Prints & Merchandise
Returns and exchanges are only accepted for items that arrive damaged or in error. If your item arrives damaged:
Contact us within 5 days of receiving your order
Include clear photos of the item and its packaging
We may offer a replacement or refund at our discretion

12. Copyright and Usage Rights
All artworks remain the intellectual property of Spikes Art Studio. By submitting reference material, you confirm you have the legal right or permission to use it.
You receive ownership of the physical artwork but not reproduction rights. We retain the right to display the finished piece in our portfolio, on social media, or for promotional purposes unless you request privacy in the form.
13. Client Responsibilities
When ordering a commission or custom item, clients must:
Provide clear, accurate references and instructions
Communicate changes promptly
Complete payment on time
Failure to follow these may result in delays or cancellation.
14. Disclaimers
Please note that color and detail may vary slightly due to differences in screens and material limitations. We are not responsible for external delays such as shipping issues, supply chain disruptions, or natural events.
15. Artist’s Rights & Content Restrictions
We reserve the right to decline any commission for any reason. We do not accept commissions featuring lewd, sexual, or nude content, as they do not align with our values.
16. Limitation of Liability
To the fullest extent permitted by law, Spikes Art Studio shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site or purchase of products. This includes loss of profits, data, or other intangible losses.
17. Indemnification
You agree to indemnify and hold harmless Spikes Art Studio from any claims, damages, losses, liabilities, and expenses arising out of your use of the Site, your violation of these Terms, or your violation of any third-party rights.
18. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.
